Terms of Service

These terms govern your use of Marketpon, operated by Marketpon, Inc. By creating an account you agree to them.

Your account

You must be 16 or older and provide accurate information. You are responsible for activity under your account and for keeping your password secure. Tell us promptly at security@marketpon.com if you suspect unauthorised access.

Your content is yours

You retain all rights to the content you upload and to the content Marketpon generates for you. We claim no ownership. You grant us only the licence needed to run the service — storing your content, processing it through our AI providers, and publishing it to the accounts you connect, on your instruction.

Publishing authority

You instruct, we execute. When you schedule or publish, you confirm you are authorised to post to that account and that the content complies with that platform's rules. You are responsible for what goes out under your brand.

Deleting a post inside Marketpon does not remove it from the platform once it is live. Remove it on the platform itself.

AI-generated output

Marketpon uses third-party AI models. Generated output may be inaccurate, may resemble output produced for other users, and is not guaranteed to be original or fit for any particular purpose. Review before you publish. You are responsible for the accuracy of any claim made in content you publish.

Credits and billing

• AI work consumes credits at the published rates. A failed generation is not charged.
• Plan credits reset each billing period. Purchased credits do not expire.
• Paid plans renew automatically until cancelled.
• Cancel any time — access continues to the end of the period you have paid for.
• We do not refund partial periods except where required by law.
• We will give at least 30 days' notice by email before changing prices.

Acceptable use

You may not use Marketpon to:

• Publish unlawful, deceptive, harassing or infringing content.
• Impersonate a person or organisation, or publish to accounts you do not control.
• Generate spam or coordinated inauthentic activity.
• Circumvent credit limits, resell access, or attack the service.
• Scrape private or restricted content through our capture tools.

We may suspend accounts that breach this section.

Third-party platforms

Instagram, Facebook, LinkedIn and X are independent services with their own terms, which override ours in respect of your use of them. They can change their APIs, revoke access, or restrict accounts at any time, and we are not liable when they do. Some limitations are theirs, not ours — for example, analytics some platforms simply do not expose.

Availability

We work to keep Marketpon running but do not guarantee uninterrupted service. Scheduled publishing depends on third-party APIs being available. We surface failures rather than hiding them, and a failed publish is always reported.

Liability

To the maximum extent permitted by law, Marketpon is provided “as is”. We are not liable for indirect or consequential loss, lost profits, or lost data. Our total liability in any 12-month period is limited to the amount you paid us in that period.

Termination

You may close your account at any time. We may suspend or terminate an account that breaches these terms. On termination we stop publishing on your behalf and you may export your content.

Changes

We may update these terms and will post the revised version here with a new date. Material changes will be emailed before they take effect. Continued use afterwards means acceptance.
